Terms & Conditions

All Wedding Cakes made by Kate Cupcake and Kate Selwood are subject to the following Terms and Conditions.  Payment of a deposit is taken as acceptance of these Terms & Conditions.  If you have any questions, please let us know.


All cakes are baked for each order using fresh ingredients.  All cakes contain milk/butter, wheat, sugar and eggs. Natural flavourings, curds and jams are used wherever possible.

Unless requested 3 months before the Wedding Date, all fruit cakes contain nuts.

The cakes are made in premises in which wheat, dairy, soya and nuts are used regularly. Kate Cupcake shall not be held responsible for allergies of the Client or their parties. Cakes can be made without any nuts/gluten/dairy BUT ALL cakes COULD contain traces of these ingredients. It is the responsibility of the Client to inform their guests that traces of allergens that COULD be present in the cake.



Fondant (the soft icing covering the cake) is not designed to be refrigerated and as such cakes with this icing should be stored in a cool dry place.  Refrigeration may cause colours to run and cake to turn sticky.

Please also remember that chocolate covered or ganached cakes can melt in warm conditions such as inside a marquee on a hot summer’s day or when left in direct sunlight.



We prefer three months notice on wedding cakes. However, we will accept short notice cakes subject to the availability of the date required.

Any cake ordered from a picture or photo of a cake produced by any other cake maker, can only be reproduced by Kate Cupcake as our interpretation of that cake and will not be an exact reproduction of the cake in the picture or photo.

Where applicable, a swatch of material for the chosen colour on the cake is to be issued to Kate Cupcake.  We will do our best to match any colour requests for icing but we cannot guarantee an exact Pantone match as colours present differently in different materials. We aim for a perfect match but this is not always possible.


Cake Quote:

The Client will receive a quote for all items discussed. The quote shows all costs for the cake, including hire items, delivery and set up.  Please read this carefully to ensure the cake has been designed as agreed.

Each wedding cake is individually costed to provide the most accurate quote based on the content and the skilled time element involved in making that design.  If you later wish to alter the design of the cake, the quote may change to reflect this.

Price promise: The price quoted at the time of booking is the final cost and it will not be increased even if my cake prices change for that design after you order has been confirmed.


To confirm a wedding Cake order, a non-refundable deposit of £50 is required. This will secure your requested date and cake order.  All deposits will be deducted from the final balance.

All orders are deemed to have been accepted by Kate Cupcake only when the deposit has been paid.


Final Balance Payments:

50% of the outstanding balance is payable 3 months before the wedding date.

The final balance payment is due 4 weeks prior to the wedding date.

For orders less than four weeks notice, the full payment is required on confirmation and is non refundable.

These dates will be clearly shown on the cake quote.



Kate Cupcake offers a bespoke service and is therefore limited in how many bookings are taken for any given week. If the Client cancels the order within 3 months of the wedding date it is unlikely that the cancelled space will be filled and therefore the following cancellation charges will apply.

1 month or less – 100% of Full Cake Cost

1 month to 3 months – 50% of Full Cake Cost

3 months or more – Loss of deposit

Cancellations MUST be in writing. On receipt of the cancellation you will be sent a confirmation letter including any amounts due at the cancellation date.  These amounts must be paid within 7 days of confirmation letter.  Any unpaid balances will be pursued through the small claims court and customers will be responsible for costs and expenses incurred in this process.


Method of Payment:

Payment may be made by Cash, Cheque, Bank Transfer or through PayPal (a 3% fee will be added to PayPal payments).  Cheques are made payable to Kate Cupcake.  Please ask for Bank Transfer and PayPal details. 



Due to the delicate nature of the wedding cakes, we prefer to deliver and set them up ourselves and will not be held responsible if the Client does not use our delivery & set up service.

Delivery charges vary according the distance of the delivery location and this will be confirmed on the Cake Quote.

Kate Cupcake require at least one hour for setting up all ordered items. This ensures that there is an appropriate amount of time to arrange the cake before guests arrive.  We will confirm our arrival time with the venue 1-2 weeks before the event,

Every possible care will be taken with the delivery and set up of the wedding cake.  A signature will be required from your venue management/wedding co-ordinator/cateror confirming the cake has been received and set up in good condition. A photograph of the cake will be taken prior to departure by us to verify that the cake has been set up and left in good condition.  Kate Cupcake cannot be held responsible for any damage of said cake or products once they are in the care of The Wedding Client/Venue. 


Cakes can also be collected from our premises at a prearranged time and date.

As well as being delicate, cakes can be very large and heavy.  They will need a flat surface to travel on.  The back seat is NOT recommended.  Cakes should also not be left in a vehicle for an extended amount of time – they melt faster than you think!

Dependent on the design, it may also not be possible to travel with the cakes pre-stacked, so assembly at the venue may be required.  If this is the case, full instructions will be given. 

A signature will be required on collection confirming the cake was in good condition.  Photographs of the cake will also be taken prior to handover.

Please note - If the cake is collected, the full responsibility for the safety of the cake is with the client and Kate Cupcake will not be responsible for any damage to the cake after it’s been collected.



From time to time our designs are published in national wedding cake magazines and other publications, we reserve the right to use any image of a cake made by Kate Cupcake for publication at a later date.  We also reserve the right to use any image of our Cakes on Social Media and our Website.

In the event that your Wedding is featured in a magazine, blog etc. the cake should be credited to Kate Cupcake.


Return of Hired Equipment

Subject to availability, cake stands can be hired for free with all wedding cakes.

A cash or cheque deposit of £50.00 is required to book a cake stand. This will be held until the stand is returned to Kate Cupcake.

All equipment must be returned within 4 days of the wedding date (unless alternative arrangements have been agreed prior to wedding in writing) or the deposit may be used to cover the cost of a replacement.  Any damages to equipment will also incur a loss of the deposit in order to cover costs of repair or replacement


Limit of Liability:

In the very unlikely event of severe medical, natural, or other emergencies, it may be necessary to retain an alternative cake designer. Kate Cupcake will make every effort to secure a replacement cake designer able and/or willing to provide similar products and services as chosen in this contract at the same/similar tariff. If such a situation should occur and a suitable replacement is not found, responsibility and liability is limited to the return of all payments received for the event.


If you are not happy:

If you are not 100% happy with your cake for any reason, please let us know within 24 hours of collection/delivery.  Wherever possible we will aim to rectify any errors before the event starts.  We will also make arrangements to collect the cake - we will need to see it to ensure we NEVER make the same mistake again.   Full refunds will never be given for any cake which has been significantly consumed, regardless of dispute, as consumption of the cake is viewed as your acceptance that the cake is adequate for the purpose for which it has been supplied.

Any refund given for disputes regarding a cake design or production of a design are completely at the discretion of Kate Cupcake and are not automatic.
